Introduction

SuperCoucou provides through its website (www.supercoucou.com) (“SuperCoucou”, “SC”, “we”, “us, or “our”) an online platform through which visitors of SuperCoucou can make reservations of all types of travel and tour arrangements (the “Services”) which are provided by independent third party suppliers (“Suppliers” or “Partners”). By making a booking through the Website, You enter into a direct (legally binding) contractual relationship with SuperCoucou and all third parties involved.

 

Terms of Use

  • You can only use the Services offered by SuperCoucou (as defined below) if You have first read these General Terms and Conditions and accepted them unconditionally. You cannot proceed with the booking process without this acceptance.
  • You agree to fulfil the obligations contained within these terms and conditions. The agreement between You and SuperCoucou comes into force as soon as SuperCoucou provides You with a written confirmation of a booking by email. Therefore, please read the Terms and Conditions carefully as they apply to your use of the internet site www.supercoucou.com. By using this site You agree to be bound by the Terms and Conditions including those revisions referred therein.
  • We may at any time modify these terms and conditions and the changes will come into effect once they are uploaded on SuperCoucou. You acknowledge and agree that your continued use of SC is subject to the terms and conditions in force at the time of your use.
  • The use of some parts or features of the site may be governed by additional terms and conditions.
  • Please make sure to inform all other travelers of all terms and conditions applicable to their travel arrangements.

 

User Profiles

  • You create your account to access the features available on the website.
  • You are responsible for the account activity and everything that is posted or shared from your account.
  • You agree that You have added true and reliable information about yourself such as your name, age and nationality, as they are on your passport. Since these details may be used when bookings are made, they must be accurate. If you tag yourself, or other users tag you in a booking, your profile information is sent to our Suppliers along with the booking.
  • We and the third parties involved reserve the right to cancel, fine or apply a price difference to the product if You provide wrong or untrue information at the time of booking.
  • We reserve the right to close your account at any time and for any reason at our sole discretion and without notice or liability of any kind.
  • You cannot use your account for commercial use. You may not impersonate someone and create an account for anyone other than yourself, or create multiple accounts.
  • You agree to notify us immediately if you notice any unauthorized use of your account.

 

Website and pictures

  • All images of hotel rooms on SuperCoucou are for representation purposes only and may not reflect the actual room You are allocated.
  • We cannot accept responsibility for any inaccurate, incomplete or misleading information about any accommodation or its facilities and/or services, except in the case of our negligence.

 

Pricing & Inclusions/Exclusions

  • Prices listed on SuperCoucoufor trips and shared transfers are per person unless otherwise specified. Prices listed on SuperCoucou for private transfers are per vehicle unless otherwise specified. Prices listed on SuperCoucou for hotels are per room unless otherwise specified.
  • Prices are based on the local tariff at the time of quoting, converted at the prevailing foreign-exchange rate as determined by SuperCoucou.
  • Price quotations are subject to change without notice until a booking has been confirmed.
  • Unless otherwise specified, prices do not include any local taxes or use-fees, including foreign departure, security, port charges, park fees, customs, immigration, agricultural, passenger-facility charges or international transportation tax. NOTE: if we’ll add credit card fees (even if after a while) then we may as well add it here.
  • Prices do not include tips/gratuities to tour directors, drivers or local guides; passport and visa fees; baggage and personal insurance; any items of a personal nature; and any beverages or food not specifically listed under “Included” on the product pages of superoucou.com or SuperCoucou-affiliated websites.

 

Suppliers' Conditions

  • Our suppliers have their own booking conditions that will be attached to each booking individually (Flights, Hotels or SC products); You will be bound by these conditions. Our Suppliers' conditions will also apply to your contract with us, and in the event of any conflict between the Suppliers' conditions and ours, the Suppliers' conditions will prevail.
  • Some of our Suppliers' conditions may limit or exclude liability on the part of the relevant Supplier and by virtue of their application to your contract with us, may also limit or exclude our liability to you.
  • SuperCoucou is not responsible for any misreading or misuse of our Suppliers' conditions, and will not be held responsible in the event of a mistake made by You in regards to the bookings.

 

Passport, Visa and immigration requirements

  • It is Your responsibility to fulfil the passport, visa and other immigration requirements applicable to your itinerary. You should confirm these with the relevant embassies and/or consulates.
  • We do not accept any responsibility in the case of You being unable to travel due to not complying with any such requirements.

 

Special requests

  • Please make sure to add any special request You may have (i.e.: dietary requirements, room location, disability…etc) in the “Special Requests” box provided at the time of booking. Your requests will be sent to the relevant Supplier and they will do their best to fulfil it. Please note that sending a Special Request does not guarantee its confirmation. Further, if the Supplier is unable to meet any such requests, neither we nor the Supplier, will have any liability to You in this respect.
  • We do not accept any conditional bookings (bookings that are conditional on the confirmation of special requests). All such bookings will be treated as “standard” bookings subject to the above provisions on special requests. If we feel unable to properly accommodate the particular needs of the person concerned, we must reserve the right on behalf of the party concerned to decline their reservation or, if full details are not given at the time of booking, cancel on behalf of the party concerned when we become aware of these details. In any event, You must give full details in writing at the time of booking.

 

Products validities, modifications and cancellations

  • All products, tours and services offered by SuperCoucou are valid as per the dates displayed at supercoucou.com. SuperCoucou is not responsible or liable for any information that it does not directly provide.
  • Occasionally our Suppliers and/or service providers make changes to tour dates, prices, inclusions, coverage, age requirements, etc. As a result, SuperCoucou reserves the right to cancel, change or substitute any service, tour, ticket or product that You have booked at supercoucou.com or through SuperCoucou-affiliated websites, at any time, for any reason. In such cases, if You are dissatisfied with the alternatives offered, You are entitled to a full refund of the original purchase price. Notwithstanding the above, when we are informed in advance by our agents, service providers and/or suppliers of a significant change to a booking and/or to a tour, product or event, we make every reasonable effort to notify You, travel agent and/or distributor as appropriate, in order to amend or re-issue the booking where feasible.

 

Activities, packages and transfers

Activities, packages and transfers are valid on the dates stated in their respective calendars. SuperCoucou is not responsible for any information that it does not directly provide.

  • Each of these products will follow the terms and conditions provided by the Suppliers offering the product.
  • By booking a package, activity or a transfer, You agree and accept the relevant terms and conditions.

 

Modifications-amendments and cancellations

  • All other date-change requests and amendments are subject to availability by our Suppliers and/or service providers; SuperCoucou cannot guarantee the success of any date-change request.
  • All requests to change the tour date or number of people for an existing booking should be directly performed in “Manage my Booking” section.
  • For any other type of amendments or modification, it has to be directed to SuperCoucou Member Care Team through the Contact Us page.
  • SuperCoucou does not charge a fee to change the date of an existing booking nor the number of travelers as long as the amendment has been done outside of the cancellation period. If, however, there is a price difference between the previous booking date and the new booking date, You will be asked to pay the difference.
  • The cancellation period for tours varies from suppliers to another with a maximum period of 60 days.
  • In case You would like to change the date of an existing booking during the cancellation period, You will be charged with the fees mentioned in the cancellation policy.

 

Group Trips

  • To create a group trip a deposit of 50% will have to be paid in order for the group trip to become active, this deposit ensures that if any member of the group trip decides to cancel his booking, the 50% price deposit will cover the price difference resulted in their cancelation for the entire group, as well as the price per person if they are staying with other travelers in the room.
  • All group trips will be automatically closed:
    1. 45 days before departure.
    2. If the group reaches the maximum capacity.
  • When the group closes, no one will be able to join, and You are requested to submit the rest of the payment based on room type (Single-double-triple) no later than 30 days before arrival.
  • You will have to add your flight details to the booking not less than 30 days before the date of the trip, as this will help the Supplier arrange proper transfer from and to the airport if transfers are included in the trip.
  • Pick up transfers from and to the airport are quoted based on a min of 2 pax. We would recommend that members of a single group trip should organize to arrive together at same flights.

 

Refunds

In regard to refund of unused/unutilized services (which are paid for and cancelled in advance), the refund amount would be worked out on the basis of cancellation policy as described above and the money would be accordingly refunded to the person who has made the payment to us. Please note that the refund process may take 5 working days to process.

 

Hotels

In relation to hotel bookings, the hotel’s specific terms and conditions for cancellations and modifications will be available to view on SuperCoucou during the booking process. When You modify a booking, it is your responsibility to ensure that it does not conflict with any other product or service You have purchased.

 

Payment

Bank and Credit Card Fees:

  • All payments to SuperCoucou are processed in USD.
  • Some banks and credit cards impose fees for international transactions. Also, a foreign transaction fee may be assessed and it may vary from one country to another according to its local law and regulations.
  • Booking international travel may be considered to be an international transaction by the bank or card company
  • The currency exchange rate and foreign transaction fee are determined solely by your bank on the day that they process the transaction.

 

Indemnification

You agree to indemnify us and our affiliates, and any such parties’ officers, directors, employees and agents from and against any claims, causes of action, demands, losses, damages, or other costs, (including reasonable legal and accounting fees) brought by You or third parties as a result of (a) your breach of this Agreement, (b) your violation of any law or rights of any third party, or (c) your use of our website.

 

Privacy Policy

You consent to our processing and sharing of personal information about You and other members of your party that You have provided to us in accordance with the terms of and for the purposes set forth in our Privacy Policy. You declare that You have read and agreed to the terms of our Privacy Policy, which can be found on our website.

 

Warranties, Disclaimers and Limitation of Liability

  • The information, software, products, and services provided by us or the suppliers or published on SuperCoucou may include inaccuracies or errors, including pricing errors. We do not guarantee the accuracy of, and disclaim all liability for any errors or other inaccuracies relating to such information that appears on SuperCoucou. We expressly reserve the right to correct any pricing errors on our Website and/or on pending reservations made under an incorrect price. In such event, if available, we will offer You the opportunity to keep your pending reservation at the correct price or we will cancel your reservation without penalty.
  • The carriers, hotels and other suppliers providing travel or other services on SuperCoucou are independent contractors and not agents or employees of us. We are not liable for the acts, errors, omissions, representations, warranties, breaches or negligence of any such Suppliers or for any personal injuries, death, property damage, or other damages or expenses resulting therefrom. We have no liability and will make no refund in the event of any delay, cancellation, overbooking, strike, force majeure or other causes beyond our control, and we have no responsibility for any additional expense, omissions, delays, re-routing or acts of any government or authority.
  • In no event shall we be liable for any direct, indirect, punitive, incidental, special, or consequential damages arising out of, or in any way connected with, your access to, display of or use of SuperCoucou or our services or with the delay or inability to access, display or use our Website whether based on a theory of negligence, contract, tort, strict liability, or otherwise, and even if we have been advised of the possibility of such damages.
  • If, despite the limitation above, we are found liable for any loss or damage which arises out of or in any way connected with any of the occurrences described above, then our liability will in no event exceed, in the aggregate, two thousand dollars (US$2,000) or the equivalent in local currency.
  • The limitation of liability reflects the allocation of risk between the parties. The limitations specified in this section will survive and apply even if any limited remedy specified in these terms is found to have failed of its essential purpose.

 

General

  • We are acting as an independent contractor and no joint venture, partnership or employment relationship exists between You and us or our Suppliers as a result of this Agreement or your use of the SuperCououwebsite.
  • We reserve the right at any time to modify this Agreement without prior notice to you. Please refer to our website at www.supercoucou.com from time to time to review the most current version of the Agreement. Your continued access or use of our Website or services signifies your acceptance of the modifications to the Agreement. You may not assign your rights or obligations under this Agreement to any third party. We may terminate this Agreement at any time for any reason, and such termination shall not affect any right to relief to which we are entitled at law or in equity.
  • This Agreement shall be governed by the laws of the laws of England and Wales without regard to its conflicts of laws principles. If any provision of this Agreement is found to be invalid, illegal or unenforceable, the enforceability of the remaining provisions will not in any way be affected or impaired.
  • Any dispute arising out of the formation, performance, interpretation, nullification, termination or invalidation of this contract or arising therefrom or related thereto in any manner whatsoever, shall be settled by arbitration under the LCIA Rules, by one arbitrator appointed in accordance with the Rules. The arbitration shall take place in London. The language of arbitration shall be English.
